BOWMAN GILFILLAN!

Are you aware that a R274 million question lies in wait for you?

One question… that is all… is the difference between a massive claim and some significant reputational damage or business as usual.

This is the cost of the Manyatshe civil claim against SAPO.
This excludes the damage done to SAPO’s reputation and the legal and other expenses incurred as a result. The claim hinges on one simple question – Who lied to and misled the SAPO Board on 11 June 2006 ?

Your lawyer, or your client?

I suggest the senior partners get the answer.
(Dave Loxton, Bowman Gilfillan - Post Office’s lawyer to SAPO Board 11 June 2006 – Page 21 paragraph 1)

“… And the Chairperson was as you know an independent advocate from the Johannesburg Bar (Advocate Mark Antrobus), he found as much. He said the evidence is overwhelming that a fraud was perpetrated and that there was – well, as he termed it, it was a breathtaking activity on the part of Mabote with the connivance of the other executives as well. So we’re not just making an assumption here, we have a lot of evidence in our pocket.”

OR

”Khutso Mampeule 06 June 2006 (Letter to all Post Office Board Members – Page 2 paragraph 10)

Vision Design House Arbitration Proceedings Update;

Quoting (Advocate Mark Antrobus) – “The fact that there was an orchestrated scheme involving these players to defraud the company was not the central focus of the evidence presented against Mabote. On the evidence led before me, I am not able to conclude with any certainty that there was such a group of persons actively engaged in assisting each other in a plan to defraud the Post Office and cover over each others tracks.

There is in my view insufficient evidence before me to make a finding that there probably was an orchestrated scheme involving the other named individuals as suggested by the company”.

For my client the answer is irrelevant. The SAPO Board was lied to, to the detriment of my client. For you... a big question.

MAIL AND GUARDIAN!

For you, one question too, you have claimed that criminal charges/criminal complaints have been filed against Maanda Manyatshe?

January 23, 2008

Dear Mr Henderson

Thank you for your further note. It is beyond my brief to furnish details of police investigations. The police were quoted in the report of 22 September as confirming that they are investigating the matter, and that is sufficient for my purposes.

Thank you

Franz Krüger
M&G ombud

If according to your letter the police were quoted in your report of 22 September as confirming that they are investigating the matter then a case will have been reported and recorded.

It has been 16 months, please provide us with the Police Station and a case reference number. As responsible journalists I'm sure you must have asked for one.

By the way Heil Hitler... "The police were quoted in the report of 22 September as confirming that they are investigating the matter, and that is sufficient for my purposes". Ombud?

Your answer is not sufficient for mine.

SAPO!

Is or was there ever a formal complaint of fraud and corruption against Maanda Manyatshe by the South African Post Office?

If there is not then why have you never set out to repudiate your CEO's statements in order to mitigate the risks of civil liability for damages?

I suggest you find the answer. I will be taking my campaign to exonerate Maanda Manyatshe to the streets.

I will commence to tie myself up kaal gat outside your offices one at a time.

3 Questions, 3 Organisations

One mans reputation.

He deserves an answer?
